1. Who we are
Ready-to-Launch is a service of Integrated Creative Group, operated by Kamesha Cogmon in Birmingham, Alabama ("ICG," "I," "me" or "my"). These terms apply to anyone who uses this website or orders services ("you" or "client").
2. Agreement
By submitting a form on this site, requesting a quote, or paying for a service, you agree to these Terms & Conditions and to the Privacy Policy. If you are acting for a company or brokerage, you confirm you have authority to bind it. If a written quote or order confirmation conflicts with these terms, the quote or confirmation controls for that project.
3. Services
Ready-to-Launch provides research-based marketing and planning documents about vacant or underused commercial property, including the Concept Brief, Vacancy Brief, Portfolio Review and Refinement, and optional add-ons such as concept renderings, rush delivery and site visits (together, "Services"). The contents of each Service are described on this website and in your quote. Each Service covers one property and the scope stated in your quote.
4. Free preliminary read and quotes
The free one-page preliminary read is a short, informal first look at a property. It is provided at no charge, creates no obligation for either party, and may be declined at my discretion. Quotes are valid for 30 days. I may decline any project for any reason before payment.
5. Fees and payment
- Fees are the flat amounts published on this site or stated in your quote, in U.S. dollars.
- Payment is due in full before research begins. Work is scheduled only after payment is received.
- Payments are processed by a third-party payment provider. I do not receive or store your full card or bank details.
- You are responsible for any taxes that apply to your purchase, other than taxes on my income.
- Portfolio discounts apply only to properties ordered and paid for together.
6. No refunds
Research, analysis and writing begin once payment is received. For that reason, all fees are non-refundable once paid, including fees for add-ons, and regardless of whether you use the deliverable or whether the property leases or sells. Your remedy for a deliverable that doesn't meet its stated scope is the revision described in section 7. The only exception: if I am unable to begin or complete your project after accepting payment, I will refund the amount paid for the work not delivered.
7. Revisions
- Each Concept Brief, Vacancy Brief and Refinement includes one revision round.
- Revision requests must be sent in writing by email, in a single consolidated message, within 30 days of delivery.
- A revision may include correcting errors, clarifying or sharpening content, adjusting a concept, or replacing one concept with another for the same property.
- Revisions must stay within the original property and scope. New properties, new research questions, or a change to the property's facts after delivery are new work and will be quoted separately.
- I will deliver the revision within 5 business days of receiving a complete request. Unused revision rounds expire after 30 days.
- Corrections of factual errors that are my fault are free at any time.
8. Delivery and communication
- Ready-to-Launch is an asynchronous service. All communication, including questions, materials, delivery and revision requests, happens in writing by email. Phone calls and meetings are not part of the Services.
- Delivery times are estimates that begin once payment and the information needed to start are received. Delays in receiving information extend the timeline.
- Deliverables are provided as digital files, usually PDF. Rush delivery dates are confirmed in writing at the time of order.
- Email delivery to the address you provide counts as delivery.
9. Your responsibilities
You agree to provide information that is accurate to the best of your knowledge, and you confirm that you have the right to share the property information, photos, floor plans and documents you send, and to have them used to prepare your deliverable. You are responsible for how you use the deliverable, including in listings and marketing, and for complying with any laws, MLS rules or brokerage policies that apply to that use.
10. Ownership and use
- Your deliverable. Once paid in full, you own the final deliverable prepared for you and may use, share, copy and adapt it, including giving it to a buyer, tenant, lender or other party.
- What I keep. I retain ownership of my methods, processes, templates, formats, scoring frameworks, general know-how and any pre-existing materials. Underlying public data remains subject to its sources' terms.
- Your materials. You keep ownership of the photos, documents and information you provide. You grant me a limited license to use them to prepare and deliver your Services.
- Portfolio use. I will not publish your deliverable, property or name without your written permission. I may describe the work in general, anonymized terms.
- Concept names. Business names in a deliverable are illustrative. I do not perform trademark searches. Check availability before using any name commercially.
11. AI tools and renderings
I use artificial intelligence tools to assist with research, drafting and image creation. All findings are reviewed by me before delivery. Concept renderings are AI-assisted illustrations of possible future uses. They are not architectural drawings, do not represent approved plans or existing businesses, and may not be accurate in scale, materials or detail. If you use a rendering publicly, you are responsible for labeling it as a concept or illustration.
12. Not professional advice
Services are marketing and planning tools only. They are not appraisals, broker price opinions, feasibility studies, engineering or architectural services, or legal, zoning, tax, accounting, financial or investment advice. Kamesha Cogmon and ICG are not licensed real estate brokers, appraisers, attorneys, architects or financial advisors, do not represent any party in a transaction, and do not receive commission or compensation tied to any sale or lease. Consult licensed professionals before making leasing, purchasing, construction, financing or investment decisions.
13. No guarantee of results
I do not guarantee that any property will lease or sell, that it will do so within any time frame or at any price, or that any concept will receive zoning approval, permits, licenses or financing, or succeed commercially. Build-out ranges, income figures and other costs are planning estimates, not quotes, bids or appraisals.
14. Third-party data
Deliverables rely on third-party sources such as government statistics, broker listings and public business listings. These sources are believed reliable but are not guaranteed to be accurate, complete or current. Census figures are estimates with margins of error. I am not responsible for errors in third-party data.
15. Confidentiality
I will keep the non-public information and materials you provide confidential and use them only to deliver your Services, except where disclosure is required by law or needed by service providers who help me operate (for example, file storage, email and AI tools), who are expected to protect it. This does not apply to information that is public or that you have made public.
16. Limitation of liability
To the fullest extent permitted by law: Services and this website are provided "as is"; I am not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost rent, lost deals or lost opportunities; and my total liability for any claim relating to the Services is limited to the fees you paid for the specific Service giving rise to the claim.
17. Indemnification
You agree to indemnify and hold harmless ICG and Kamesha Cogmon from claims, losses and expenses, including reasonable attorneys' fees, arising from materials you provide without the right to share them, your use of a deliverable, or your breach of these terms.
18. Ending a project
You may stop a project at any time by email; because fees are non-refundable, no refund is due. I may end a project if required information isn't provided within 30 days of payment, if you breach these terms, or if continuing would be unlawful or unethical. If I end a project for reasons other than your breach or inaction, section 6's exception applies.
19. Governing law
These terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Jefferson County, Alabama, and you consent to their jurisdiction. Before filing any claim, both parties agree to try to resolve the dispute in good faith by email for 30 days.
20. General
These terms, your quote and the Privacy Policy are the entire agreement between us about the Services. If any part is found unenforceable, the rest remains in effect. Not enforcing a term is not a waiver of it. You may not transfer your rights under these terms without my written consent. I may update these terms by posting a new version with a new effective date; the version in effect when you paid applies to that project.
